Undiet Terms of Use

These Terms of Use ("Terms") govern your use of the Undiet mobile application and the services around it, including the community (together, the "Service"). Please read them. They contain limits on our liability, the rules of the community and an important statement that Undiet is not medical advice. If you are a consumer in the European Union, nothing in these Terms takes away rights the law gives you.

OurPrivacy Policydescribes how we handle your data. Because the Service processes health data, section 9 of these Terms repeats the most important data facts, so nothing important hides behind a link.

1. Who you are agreeing with

1.1 These Terms are an agreement between you and Krnic CommV, a Belgian commanditaire vennootschap (CommV) in Gent, Belgium, enterprise number [Belgian enterprise number (KBO/BCE), to be completed] ("Undiet", "we", "us"). We operate and publish the Service and we are the controller of the personal data it processes.

1.2 By creating an account or using the Service you confirm that you have read and accept these Terms. If you do not agree, do not use the Service.

1.3 Accepting these Terms is separate from the explicit consent the app asks for before it stores your health data. That consent is requested in its own step, recorded separately, and can be withdrawn at any time (section 9.3).

2. What the Service is

2.1 Undiet is a weight journey companion. It lets you record a daily check-in (your weight and how the day felt), quick logs (meals, drinks, movement, notes, GLP-1 doses), start and switch diet programs from a catalog and see them on one timeline, keep private progress photos on your device, and take part in a community of people on the same road.

2.2 Undiet tracks, connects and visualizes what you log. It does not prescribe a diet, a calorie target, a medication or a plan, and it does not judge you. Rewards in the Service are for taking part, never for a change in weight.

2.3 Undiet isnota medical device, a healthcare service, a diet or treatment program, or a substitute for a doctor, dietitian or pharmacist. See section 10.

2.4 Some features need a network connection (sign in, sync, the catalog, the community). Progress photos are processed and stored on your device only and are never uploaded.

3. Age

3.1 You must be at least16 years oldto use the Service. 16 is the age at which a person can consent to the processing of their own personal data under Belgian law.

3.2 We ask you to confirm your age when you sign up. We do not knowingly keep accounts for anyone younger, we have no mechanism for parental consent, and we delete such accounts when we learn of them.

4. Your account

4.1 You sign in with an email address, with Sign in with Apple or with Sign in with Google. Keep access to that email or account safe: whoever controls it controls your Undiet account. Tell us at[email protected]if you believe someone else has used your account.

4.2 One person, one account. You may not use the Service on behalf of someone else, share an account, or create an account for anyone under 16.

4.3 If you used the earlier version of Undiet (before 2.0), signing in with the same email address imports your earlier entries into your new account, as described in the Privacy Policy.

5. Licence, and the app stores

5.1 Subject to these Terms, we grant you a personal, non-exclusive, non-transferable, revocable licence to install and use the Service on devices you own or control, for your own personal, non-commercial use.

5.2 You may not copy, modify, distribute, sell, rent, reverse engineer or attempt to extract the source code of the Service, except where the law allows it regardless of this clause.

5.3Apple.If you downloaded Undiet from the Apple App Store, Apple's standardLicensed Application End User License Agreement("Apple EULA") applies to your use of the app, and these Terms supplement it. If these Terms and the Apple EULA conflict, the Apple EULA prevails for the matters it governs. You acknowledge that these Terms are between you and us, not Apple; that we, not Apple, are responsible for the Service, its maintenance and support, any warranty, any product claim and any intellectual property claim; and that Apple and its subsidiaries are third party beneficiaries of these Terms and may enforce them against you. You confirm that you are not located in a country subject to a United States government embargo or designated as a terrorist supporting country, and that you are not on any United States government list of prohibited or restricted parties.

5.4Google.If you downloaded Undiet from Google Play, your use is also subject to the Google Play Terms of Service. Google is not a party to these Terms and is not responsible for the Service.

6. Undiet Plus

6.1Free.Keeping a journey in Undiet is free: daily check-ins, quick logs, the catalog with one program at a time, the journey graph, private progress photos and the community. No payment is needed for any of it.

6.2The subscription.Undiet Plus is an optional subscription that adds advanced analytics, several programs running at the same time, unlimited photo history, and the plateau and GLP-1 maintenance dashboards. It costs€6.99 per monthor€39.99 per year. The yearly plan starts with a7 day free trial. Prices are shown in the app in your store's currency and may differ by country; the price shown in the store at the moment of purchase is the price you pay.

6.3Billing.Undiet Plus is sold and billed through the Apple App Store or Google Play. Apple or Google processes your payment; we never see your card. Our subscription provider, RevenueCat, keeps your entitlement in sync using a pseudonymous subscriber id.

6.4Renewal.The subscription renews automatically at the end of each period at the then current price unless you cancel at least 24 hours before the period ends. If you start the free trial and do not cancel before it ends, the yearly subscription begins and is charged to your store account.

6.5Cancelling.Cancel at any time in your Apple or Google subscription settings. Cancellation takes effect at the end of the period you paid for; you keep Undiet Plus until then. Because the stores handle billing, we cannot cancel a subscription for you. Deleting the app or closing your account doesnotcancel a subscription.

6.6Restoring.On a new device or after reinstalling, use "Restore purchases" in the app to pick up an active subscription through your store account.

6.7Refundsare handled by Apple or Google under their policies. Ask the store first; if you are stuck, write to[email protected]and we will help where we can.

6.8Right of withdrawal.If you are an EU consumer you normally have 14 days to withdraw from a distance contract for digital content. By starting a subscription or free trial and asking for immediate access to Undiet Plus, you agree that performance begins at once and acknowledge that you lose the right of withdrawal once it has begun. Your mandatory consumer rights and the store refund routes are not affected.

6.9 We may change prices or what Undiet Plus includes. Price changes apply from your next renewal and the store will tell you in advance, as its rules require.

7. The community and your content

7.1Your content.You keep the rights to what you post (posts, comments, reactions). You grant us a non-exclusive, royalty free, worldwide licence to host, store, display and distribute it within the Service so that other members can see it, and to make copies as part of backups and moderation, for as long as it is in the Service. We do not use your content to train AI models and we do not sell it.

7.2What is never shared.Your health data, your journey and your photos are private and are not part of the community unless you explicitly choose to show a figure (for example your current program or the trend of the current period) on your public card. Photos cannot be posted at all.

7.3The rules.The community exists so that people on the same road can support each other. You agree not to post content that:

(a) encourages, glorifies or instructs disordered eating, extreme restriction, purging, or starvation, or treats hunger as an achievement;

(b) gives medical advice, including dosing advice for GLP-1 or any other medication, or presents a diet as a cure or treatment for any condition;

(c) shames, harasses, bullies, threatens or discriminates against anyone, including about their body, weight, food or pace;

(d) is sexual, violent, hateful, or illegal;

(e) advertises or sells products or services, recruits for other platforms, or is spam;

(f) contains other people's personal data, or anything you do not have the right to share;

(g) is before and after imagery, or any other image; the community is text.

7.4Moderation.Every new post and comment is checked by an automated AI moderator before it is shown. Content that breaks the rules is held back or removed. Members can report any post, comment or profile, and block any member, with one tap. We review reports and appeals, and we may remove content, warn, restrict or suspend accounts, and in serious or repeated cases close them. We are not obliged to moderate everything and cannot guarantee that every rule breaking post is caught before someone sees it. If you believe a decision about your content was wrong, write to[email protected]and a person will look at it.

7.5Credits.Credits are a community mechanic: you earn them by taking part (checking in, posting, commenting, supporting others), never for losing weight, and you give them to support other members. Credits have no monetary value, cannot be bought, sold, transferred outside the Service or redeemed for anything, and may be reset or changed. Attempts to farm credits through automation or fake accounts may lead to suspension.

7.6Other members' contentis their own view, not ours. We do not check it for accuracy. Nothing in the community is medical advice (section 10).

8. Acceptable use

You agree not to: use the Service in breach of the law; try to access other accounts or our systems without permission, or bypass security or moderation; scrape, crawl or copy the Service or its content with automated tools; interfere with, overload or disrupt the Service; upload malware; use the Service to track or make decisions about another person; or reverse engineer it except where the law permits.

9. Your data, in short

9.1 The full picture is in thePrivacy Policy. If anything about data handling here differs from it, the Privacy Policy wins.

9.2Health data.Your weight, how you feel, your logs and any medication doses are special category data under article 9 GDPR. We process them only with your explicit consent, which the app asks for in its own step before anything is stored.

9.3Withdrawing consent.You can withdraw at any time by closing your account in the app (Profile, then Account, then Close your account) or by writing to[email protected]. Withdrawal stops future processing and, because a journey cannot exist without this data, means we can no longer keep a journey for you.

9.4Photosare processed and stored on your device only and are never uploaded.

9.5Analytics.The app records pseudonymous usage events (that an action happened, never its content or values) to improve the product. You can switch it off in Profile, under Privacy.

9.6Where.Our servers and database are in the EU (the European Union (Frankfurt, eu-central-1)). Our processors are listed in the Privacy Policy.

9.7Your rights.Export everything (Profile, then Account, then Export my data), delete everything (Profile, then Account, then Close your account), correct, object, restrict, port, and complain to the Belgian Data Protection Authority (Gegevensbeschermingsautoriteit / Autorité de protection des données, GBA/APD).

10. Not medical advice

10.1 Undiet is a tracking companion. It does not provide medical, nutritional, pharmaceutical or psychological advice, diagnosis or treatment, and nothing in the app, the catalog, the dashboards or the community is a substitute for a qualified professional.

10.2 The catalog describes programs people follow. Listing a program is not a recommendation, and the Service does not claim that any program is safe or effective for you. Talk to your doctor, dietitian or pharmacist before starting, stopping or changing any diet, fasting protocol or medication, and especially about GLP-1 therapy and what comes after it.Never change a prescribed dose because of something you saw in an app.

10.3 If you have, or think you may have, an eating disorder, or if a diet is making you unwell, stop and seek help from a professional. The Service is not designed for crisis situations and does not monitor users.

10.4 The numbers the app shows are your own entries and simple calculations on them. They can be wrong if an entry is wrong, and they are not a measure of your health.

11. Warranties and liability

11.1 To the extent the law allows, the Service is provided "as is" and "as available", without warranties of any kind, express or implied. We do not promise that the Service will be uninterrupted or error free, or that any trend, dashboard or community content will be accurate or suitable for any purpose.

11.2 To the extent the law allows, we are not liable for indirect, incidental, special or consequential damages, or for loss of data, profits or goodwill, arising from your use of or inability to use the Service. Where liability cannot be excluded, our total liability for all claims in any twelve month period is limited to the amount you paid us for the Service in that period.

11.3 Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law, including for death or personal injury caused by our negligence, for fraud, or for gross negligence or wilful misconduct. If you are a consumer, your statutory rights are unaffected.

12. Ending things

12.1 You can stop using the Service at any time and close your account in the app (Profile, then Account, then Close your account). This deletes your account and everything in it, immediately and irreversibly. An email route and the details are athttps://undiet.krnic.be/delete-account. Closing your account does not cancel a store subscription (section 6.5).

12.2 We may suspend or close your account if you materially breach these Terms, if the law requires it, or to protect the Service or other members. Where reasonable, we will tell you why and give you a chance to respond.

12.3 On termination the licence in section 5 ends. Sections 7.1 (for content still being removed), 9, 10, 11 and 14 survive.

13. Changes

13.1 We may change, add to or remove features of the Service, including what Undiet Plus contains, within what the law allows.

13.2 We may update these Terms. For material changes we will tell you in the app before they take effect. If you do not agree with the updated Terms, stop using the Service and close your account. Changes do not apply retroactively where the law prohibits it.

14. Governing law and complaints

14.1 These Terms are governed by the laws of Belgium. If you are a consumer living in another EU country, you also keep the protection of the mandatory consumer law of that country, and you may bring proceedings in its courts.

14.2 If you have a complaint, write to[email protected]first; we try to solve things directly. EU consumers may also use out of court dispute resolution, including the bodies listed by the European Commission. None of this limits your right to go to court or to complain to a data protection authority.
